Additionally, it provides a framework for the preservation of lineage, the protection of individual rights, and the promotion of a harmonious and responsible family life within the Muslim community.
Classification Of Guardianship And Parental Rights: Guardianship and parental rights in Islamic law are classified into two main categories: wilaya (guardianship) and irada (parental rights). Wilaya involves the legal authority and responsibility for decisions and protection, with distinct roles assigned to different family members, while irada emphasizes the moral and financial duties of parents towards their children, encompassing their upbringing, education, and support.
Marriage And Divorce Under Muslim Law : Marriage under Muslim law is a sacred contract, governed by Sharia, which involves a mutual agreement between a man and a woman, followed by a solemn ceremony and the payment of a dowry (mahr). Divorce, known as "Talaq," is also regulated under Islamic law, allowing either spouse to initiate the dissolution of the marriage through specified procedures, with the aim of preserving the rights and dignity of both parties while adhering to Quranic principles.
Classification Of Will And Inheritance: In Islamic law, wills are classified into two categories: Wasiyya (testamentary will) and Wasf (specific bequest), allowing Muslims to allocate a portion of their wealth beyond the fixed shares of inheritance to beneficiaries of their choice. Inheritance is governed by the laws of "Fara'id," which specify fixed shares for eligible heirs based on familial relationships, ensuring the equitable distribution of a deceased person's assets among surviving family members.
Introduction Dower, Law Of Gifts, Law Of Wakf: Dower (Mahr) in Islamic law represents the mandatory gift given by a husband to his wife upon marriage, signifying his financial commitment and respect for her. The Law of Gifts (Hibah) allows Muslims to make voluntary, irrevocable gifts during their lifetime, promoting generosity and wealth distribution within the community.
